End User License Agreement

Version: 4.0.2 Developer: Simon Kelly (https://simonkelly.uk) Last Updated: June 2026 BY INSTALLING OR USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE. 1. LICENSE GRANTS & EDITIONS ------------------------------------------------------------------------------- The Software is licensed, not sold, to you by Simon Kelly ("Developer") for use strictly in accordance with the terms of this license. Your rights depend on the type of license tier acquired: A. DEMO / TRIAL EDITION: Granted automatically upon installation. You may process up to 500 images total for evaluation purposes. Features such as advanced multi-page PDF processing and premium formats (HEIC, AVIF, TIFF, PSD, SVG, TGA, PCX) are locked. B. PERSONAL LICENSE: Restricts use to one (1) single user device for non- commercial, personal use only. Unlocks unlimited processing of core formats (JPEG, PNG, GIF, WEBP, BMP, and single-page PDFs). C. PROFESSIONAL / COMMERCIAL LICENSE: Unlocks all advanced features, multi- page PDF processing, vector assets (SVG), and premium archival formats. Allows installation on multiple devices owned by the license holder as demarcated at the time of purchase. Commercial tier permits use within corporate, organizational, or commercial workflows. 2. LICENSE RESTRICTIONS & SECURITY ------------------------------------------------------------------------------- You agree not to, and you will not permit others to: • License, sell, rent, lease, assign, distribute, host, or otherwise commercially exploit the Software outside your approved tier parameters. • Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Software binary, including its internal license-key validation or hardware-fingerprinting logic. • Bypass, modify, defeat, or circumvent any of the security features or gates protecting locked premium formats. 3. HARDWARE BINDING & TELEMETRY ------------------------------------------------------------------------------- To prevent software piracy and ensure compliance with licensing policies, the Software utilizes a local hardware-fingerprint engine based on immutable system values. This signature securely activates the Software online. No personally identifiable file data, image contents, or private user info is scanned, collected, or transmitted during this hardware-matching routine. 4. INTELLECTUAL PROPERTY & COPYRIGHT ------------------------------------------------------------------------------- The Software, including without limitation all source code, graphic assets (including the application header and associated icon), layout matrices, text instructions, and user manuals, are and shall remain the sole and exclusive property of Simon Kelly. The Software is protected by copyright laws and international copyright treaties. 5. TERMINATION ------------------------------------------------------------------------------- This Agreement shall remain in effect until terminated by you or the Developer. The Developer may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement if you fail to comply with any term or condition herein. Upon termination, you must cease all use of the Software and delete all copies from your computer environments. 6. DISCLAIMER OF WARRANTY ------------------------------------------------------------------------------- THE SOFTWARE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE SOFTWARE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITATION TO THE FOREGOING, THE DEVELOPER PROVIDES NO WARRANTY OR UNDERTAKING THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, OR BE COMPLETELY COMPATIBLE WITH ANY OTHER SOFTWARE, APPLICATIONS, OR OPERATING SYSTEMS WITHOUT REQUIRING PERIODIC CONFIGURATION. 7. LIMITATION OF LIABILITY ------------------------------------------------------------------------------- NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR, THE ENTIRE LIABILITY OF THE DEVELOPER UNDER ANY PROVISION OF THIS AGREEMENT AND YOUR EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE. IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, OR FOR CORRUPTION OF IMAGE ASSETS) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE. 8. GOVERNING LAW ------------------------------------------------------------------------------- The laws of the United Kingdom shall govern this Agreement, excluding its conflicts of law rules. Any legal action or proceeding arising under this Agreement will be brought exclusively in courts located within the UK.
